Terms of Use

These Terms govern your use of Tonada's website and music discovery features, including those available through third-party platforms and integrations (the "Service"). The Service is provided by Tonada OÜ, a company registered in Estonia, registry code 17340415 ("Tonada", "we", or "us"). By using the Service, you agree to these Terms. If you do not agree, please do not use it.

1. What the Service provides

Tonada helps you explore musical directions for your brand or space and listen to samples from our catalog. Recommendations are provided for inspiration and evaluation and may not always match your needs.

Using our free music discovery features does not start a paid subscription or purchase a music license. Any paid services are subject to the pricing, subscription terms, and licensing conditions presented when you sign up or purchase.

2. Music and permitted use

You may listen to samples through the Service to evaluate Tonada for yourself or your business.

Music, recordings, branding, and other content remain the property of Tonada or its licensors. Access to samples does not transfer ownership or grant permission to redistribute, resell, broadcast, incorporate them into other content, or use them as background music in a venue. Those uses require a separate license from Tonada, unless otherwise permitted by law.

3. Responsible use

You must use the Service lawfully and respect the rights of others. You must not interfere with its operation, bypass access restrictions, introduce malicious software, or extract music or other content without authorization.

Only submit information you are entitled to share and that is needed for your request. Please do not submit sensitive personal data.

4. Privacy and third-party platforms

Our Privacy Policy explains how we handle personal data.

When you access Tonada through a third-party platform, information needed to fulfill your request may be shared between that platform and Tonada. Your use of the third-party platform is governed by its own terms and privacy policies. Tonada is responsible for the Tonada Service.

5. Availability and responsibility

We aim to provide a useful and reliable Service, but do not guarantee uninterrupted availability, error-free operation, or the accuracy or suitability of every recommendation.

To the extent permitted by law, the Service is provided "as is" and "as available", without warranties.

To the extent permitted by law, Tonada is not liable for indirect or consequential loss, or for loss of profit, revenue, or data, arising from the Service.

Nothing in these Terms excludes or limits liability for intent or gross negligence, or any other liability that cannot legally be excluded, and nothing limits your mandatory consumer rights.

6. Changes and ending use

We may update the Service, and we may restrict or suspend access, without prior notice where needed, where reasonably necessary for security, legal compliance, or violations of these Terms. You may stop using the Service at any time.

We may update these Terms and will publish the revised version with a new date. Where required by law, we will provide additional notice or obtain your agreement before changes take effect.

7. Governing law

These Terms are governed by the laws of Estonia. Disputes are settled by the Estonian courts. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, or your right to bring a claim there.

These Terms are published in several languages. If the versions differ, the English version prevails.
